EHCP Annual Reviews

What happens after the annual review meeting?

After the annual review meeting:

  • a report of what happened in the meeting must be prepared and circulated to everyone who attended or submitted information to be discussed within two weeks of the meeting
  • the LA must review the report of the annual review meeting
  • the LA must notify the parent of the child or young person of their decision within four weeks of the meeting

The LA can make one of three decisions:

  • to maintain the EHC plan and not make any changes
  • to amend the EHC plan
  • to cease to maintain the EHC plan

You will be sent a copy of this decision. If you don't agree with the LA decision, you can appeal to the SEND tribunal. If the local authority decides to amend the plan they must start the process of amending it straight away.
